Flashforge Cloud User Agreement

Effective Date: November 12, 2025

This Agreement governs your access to and use of Flashforge Cloud services, software, websites, and connected devices in the United States (the “Services”). By accessing or using the Services, you agree to be bound by this Agreement.

1. Your Account and Use

You must be at least the age of majority in your state and capable of forming a binding contract. You are responsible for keeping your login credentials confidential and for all activities under your account. You must not misuse the Services or attempt to circumvent any security feature or usage limitation, including by probing, scanning, or testing the vulnerability of any system or network.

2. Content You Provide

You retain the rights you lawfully hold in the content you provide (including models, files, images, videos, code, and metadata). To operate, safeguard, and improve the Services and to comply with applicable law, you grant Flashforge a limited license to host, review, scan, analyze, transmit, display, reproduce, and create derivative works necessary to provide the Services. You represent that you have all necessary rights to upload or share the content you provide. You are solely responsible for your content and for the consequences of sharing it. You must back up your content; Flashforge does not promise to retain or restore any specific content.

3. General Prohibited Content and Conduct

You may not upload, share, or distribute content that violates national, state, or local law; that endangers public safety; or that infringes the lawful rights of others, including intellectual property, privacy, or publicity rights. Content that is pornographic or sexually exploitative; that incites or depicts graphic violence or promotes harm; or that expresses hate or targeted harassment against protected classes is prohibited. You may not post content that threatens public safety or facilitates illegal activity, including the promotion, sale, or distribution of illegal weapons, ammunition, explosives, explosive precursors, or similarly regulated hazardous items. You must not attempt to access the Services using automated means without permission; reverse engineer; interfere with or disrupt the Services; or attempt to bypass geofencing or other technical or policy-based restrictions.

4. Firearm-Specific Prohibited Uses

You may not use the Services or devices to create, upload, share, generate, download, transmit, print, or otherwise handle any file, model, or material that is designed, intended, or reasonably likely to be used to manufacture, assemble, modify, or enhance a firearm or an essential component (including frames/receivers, barrels, slides, bolts, triggers, magazines, suppressors/silencers, and jigs/templates for such items), including “Privately Made Firearms/‘Ghost Guns’” and undetectable firearms. You may not use the Services to create or facilitate unfinished frames or receivers, conversion devices (including auto sears), suppressors or silencers, high-capacity magazines, or any parts, kits, fixtures, templates, CAD/STL/STEP/G-code, or instructions whose primary purpose is to manufacture, assemble, modify, or enhance any such items, and these prohibitions apply irrespective of material or production method.

5. Other Weapons and Hazardous Items

You may not use the Services or devices to create, upload, share, generate, download, transmit, print, sell, purchase, advertise, or otherwise facilitate explosives, explosive precursors or formulations, IED components, ammunition or ammunition components where prohibited by law, switchblades or similarly regulated knives, brass knuckles, stun devices, or other restricted weapons; or any kits, parts, fixtures, templates, or other technical files or instructions whose primary purpose is to manufacture, assemble, modify, or enhance any such items.

6. Review and Controls

To enforce safety policies, Flashforge uses machine screening and other reasonable measures to detect and remove prohibited content, and may use human review where appropriate. Flashforge may remove content, suspend or terminate accounts, and report to law enforcement where legally required or reasonably necessary to protect safety. Detection is not guaranteed, and Flashforge is not obligated to review all content. By using upload or sharing features, you consent to any review of uploaded models and related data for trust-and-safety and compliance purposes.

7. State-Specific Compliance

If you are located in a U.S. state with specific restrictions, you must not use the Services in any manner that would violate those state laws, and you are responsible for complying with relevant local requirements.

8. User Representations; Export Controls

You represent and agree that you will not circumvent or attempt to bypass review, geofencing, or other safety measures; that you will not upload, share, publish, download, export, re-export, or otherwise make available firearm build files or related technical data in violation of U.S. export controls under ITAR/EAR; and that you will reasonably cooperate with Flashforge in investigations into safety or legal compliance. Flashforge may block or remove content and suspend access to comply with applicable law.

9. Law Enforcement Cooperation and Retention

Flashforge may preserve and disclose account information to law enforcement or regulators when legally required or where Flashforge, in good faith, believes disclosure is necessary to prevent serious harm or unlawful manufacture of weapons. Flashforge has no obligation to retain any particular content for any specific period and does not guarantee retrieval of any data you or others upload or generate.

10. Customer Consents to Processing and Safety Review

You acknowledge and expressly consent that Flashforge may collect, use, process, analyze, review, store, transmit, and disclose account, device, network, and job-related data to provide, operate, maintain, and improve the Services; to enforce this Agreement; to protect safety and security; and to comply with law and respond to lawful requests from public authorities, including cross-border transfers as reasonably necessary.

11. Privacy

Your use of the Services is also subject to the Flashforge Privacy Policy, which explains how we collect, use, and share information. The Privacy Policy may be updated from time to time. Your continued use of the Services after an update constitutes acceptance of the updated policy.

12. No Warranties; Services “AS IS”

The Services are provided “AS IS” and “AS AVAILABLE,” and Flashforge disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and does not guarantee that the Services will be uninterrupted, secure, or error-free or that content will be accurate or suitable for any particular use.

13. Limitation of Liability

To the maximum extent permitted by law, Flashforge shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or business interruption, even if advised of the possibility of such damages; and the aggregate liability of Flashforge arising out of or relating to the Services or this Agreement shall not exceed the amounts paid by you to Flashforge for the Services giving rise to the claim in the twelve (12) months preceding the event giving rise to liability.

14. Indemnification by Users

You agree to defend, indemnify, and hold harmless Flashforge, its affiliates, and their respective officers, directors, employees, contractors, and agents from and against any and all claims, demands, actions, investigations, penalties, fines, losses, liabilities, judgments, damages, costs, and expenses (including reasonable attorneys ’ fees) arising out of or related to your content, your use of the Services or devices, your breach of this Agreement or applicable law, or your infringement or violation of any third-party right.

15. Changes to These Terms

We may update this Agreement to reflect legal or regulatory changes or service updates and will provide conspicuous notice of any material change and its effective date. If you do not agree to the updated terms, you must stop using the Services.

16. Termination

You may stop using the Services at any time. We may suspend or terminate access to the Services or your account at any time for violation of this Agreement or to protect safety. Provisions that by their nature should survive termination will survive.

17. Governing Law; Dispute Resolution

This Agreement is governed by the laws of the State of New York, without regard to conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in the applicable jurisdiction, unless a different forum is required by law.
